Bloomington Motorcycle Accident Attorney

Last updated on March 24, 2025

A motorcycle accident can be a life-changing event. Injuries to the rider are often severe and sometimes fatal. In some cases, the accident happens because a driver isn’t paying attention. Many times, the car or truck driver will say that he or she didn’t see the motorcyclist until it was too late.

If you or a loved one were seriously injured on a motorcycle, including falling from a motorcycle, you may have a personal injury case if someone else’s negligence caused or contributed to the accident. You should talk to an attorney who understands how motor vehicle accident lawsuits are handled.

  • The wrongful death of a loved one

Do You Have To Wear A Helmet In Indiana?

Motorcycle riders 18 and older do not have to wear a helmet under Indiana law. Minors riding a motorcycle are required to wear a helmet.

According to Indiana Code § 9-18.1-14-11, any person under the age of 18 who is driving or riding an off-road vehicle must wear a helmet that complies with the standards set by the United States Department of Transportation under 49 CFR 571.218, as applicable on January 1, 1979. However, this law does not apply to motorcycles.

How Much More Dangerous Are Motorcycles Than Cars?

According to recent data, motorcyclists are more likely to suffer serious injuries or fatalities compared to car occupants. Although motorcycles account for less than 2% of all collisions in Indiana, they are involved in approximately 16% of all traffic fatalities.

Motorcycles lack the protective structure of passenger vehicles, exposing riders to greater risks in the event of a crash. Several factors contribute to these dangers:

  • Lack of enclosure: Unlike cars, motorcycles do not have a reinforced frame, air bags or crumple zones to absorb impact.
  • Lower visibility: Motorcycles are smaller and harder to see, increasing the likelihood of being struck by other vehicles.
  • Less stability: Two wheels provide less balance than four, making motorcycles more susceptible to road hazards and sudden maneuvers.
  • Direct impact: In an accident, motorcyclists are often thrown from their bikes, increasing the chances of traumatic brain injuries and fractures.
  • Higher fatality rates: Without safety features such as seat belts, motorcyclists are more likely to suffer serious injuries in collisions.

Given these risks, working with an experienced motorcycle accident attorney can be crucial after a crash. They can help ensure injured riders can recover damages for medical expenses, lost wages, and pain and suffering.
